Armed Robber Suing Pizza Restaurant Because He Was ‘Defenseless,’ ‘Suffered Attack From Employees’ Who Tried to Stop Him

A man sentenced to 15 years for robbing a Delaware pizzeria has filed a lawsuit against the restaurant accusing the employees of using “unnecessary” force when they tackled him after he tried to rob the eatery at gunpoint.

The incident occurred in November of 2010 when now-23-year-old Nigel Sykes entered through the back door of Seasons Pizza and made off with $140.

As he was about to walk out, one of the employees reportedly grabbed him from behind while another grabbed his gun. The gun went off, nearly striking another employee.

“After a short struggle, the defendants successfully obtained the handgun from me,” Sykes, who has no lawyer, said in his self-written complaint. “That is when the assault began. All Talk: Gun Prosecutions Plummet Under Obama Administration

While President Obama decries gun violence and presses for more laws to restrict ownership, his Justice Department has prosecuted 25 percent fewer cases referred by the main law enforcement agency charged with reducing firearms violence across the country, a computer analysis of U.S. prosecution data shows.

Federal prosecutors brought a total of 5,082 gun violation cases in 2013 recommended by the Bureau of Alcohol, Tobacco, Firearms and Explosives, compared with 6,791 during the last year of George W. Bush’s presidency in 2008, according to data obtained from the Executive Office of U.S. Attorneys.

The 2013 totals represent a 42 percent decline from the record number of 8,752 prosecutions of ATF cases brought by the Justice Department in 2004 under Mr. Bush, according to the data.

Syracuse University’s Transactional Records Access Clearinghouse, regarded as one of the premier researchers on federal prosecution performances and trends, analyzed the data at the request of The Washington Times.

The CBS Evening News did cover this story, but it only was in the form of a 12-second news brief from anchor Scott Pelley. Pelley grimly reported: Today’s report on the housing market is raising concerns about the economic recovery. Sales of new homes dropped sharply last month, more than 8%, and that’s the largest decline in nearly a year.
